Student Enrollment Agreement

THIS IS AN AGREEMENT made this ______day of _________,
20____  by and between THE MONTANA SCHOOL OF TAXIDERMY, at 3280 Green Meadow Drive, Suite A, Helena, Montana 59602, herein called "MST" and of __________________________ herein called "student".

Training

1.1 Commencing on the _______day of _______, 20 ____ for a period of:

( ) 48 days - Full Commercial Taxidermy Course (big game, birds, fish and basic tanning), as described in the School Catalog

( ) 3 weeks - Big Game Course, as described in the School Catalog

( ) 9 days - Bird Course, as described in the School Catalog

( ) 3 weeks - Fish Course, as described in the School Catalog

( ) 5 days - Advanced Habitat, as described in the School Catalog

( ) 3 weeks - Commercial Tanning Course, as described in the School Catalog (taught in March)

All commercial taxidermy classes will be held Monday through Saturday from 8:00 a.m. to 12:00 noon and from 1:00 to 5:00 p.m., with one Saturday each month given off to the students for specimen collecting trips (fishing). MST will remain open during the lunch hour and Monday, Tuesday, and Wednesday nights for students to work on individual projects. MST will be at 3280 Green Meadow Drive, Suite A, Helena, Montana and qualified personnel will:

a) Train student in MST's techniques and methods of preparing, preserving and mounting of ( ) big game, ( ) gamebirds, ( ) fish, ( ) tanning, and ( ) habitat.;

b) Disclose to student trade secrets and knowledge relating thereto;

c) Disclose to student techniques and trade secrets of merchandising and advertising such specimens.

1.2 In connection with said training MST will furnish all paint and incidental expendable supplies.

1.3 Student will be responsible for his own forms, skins, habitat material, rug material, eyes, airbrush kit and bondo used. The School catalog has information on expected expense to the student for such items. An average cost for this expense is around $800.

1.4 Student will prepare and mount all specimens following instruction and procedures as directed by MST instructor.

1.5 During said period and thereafter, MST will be available for consultation and advice at reasonable times.

Tuition

2.1 Student agrees to pay the following:

a) A down payment on the tuition has been paid upon signing this agreement and the balance shall be paid in full on Friday at the end of the first week of classes, except in the case of those costs being paid directly to the Montana School of Taxidermy by state or federal agencies.

Refund Policy

3.1 FULL REFUND: Student shall receive full refund of all money by student if: The student cancels this contract within two weeks before the scheduled beginning of the enrolled class; the student is unqualified; or, the student's enrollment was procured as the result of any misrepresentations in the School's advertising, promotional material or solicitor's representations.

3.2 PARTIAL REFUND: If a student cancels this contract after expiration of the three (3) business day cancellation privilege, student shall be entitled to a refund (which will be made within 30 days after the school dismisses the student or receives notice of withdrawal) of that part of the tuition that exceeds the following amounts:

3.3a PARTIAL REFUND POLICY (FULL COURSE, FISH COURSE, BIRD COURSE, BIG GAME COURSE, ADVANCED HABITAT): A student who withdraws or is dismissed by the School prior to attending any classes will be charged l5% of the total cost of the course or $100.00 whichever is less. A student who withdraws or is dismissed by the School during or at the end of the first week of class will not be refunded his or her initial enrollment deposit or money spent for the portion of the course or courses the student has used. A student who withdraws or is dismissed by the School after the beginning of the second week but prior to completing 75% of the course, the School will not refund his or her initial deposit and will pay the pro-rate portion of the second week he/she attends.

The pro-rate portion shall be calculated in the following manner:

(I) The School shall determine the number of class days elapsed from the start of the student's attendance until the student's last date of attendance.

(2) The number of class days elapsed shall be divided by the number of class days required to complete the course.

(3) The resulting number shall be multiplied by the total cost of the course of instruction. A student who withdraws or is dismissed by the School after completing 75% of the course will be charged the total cost of the course.

3.3b PARTIAL REFUND POLICY (BIRD COURSE): A student who withdraws or is dismissed by the School prior to attending any classes will be charged 15% of the total cost of the course or $100.00 whichever is less. A student who withdraws or is dismissed by the School after attending any class prior to completing 25% of the course will be charged 15% of the total cost or $100.00 whichever is less plus a pro-rare portion of the total cost of the course. A student who withdraws or is dismissed by the School after completing 25% but less than 75% of the course will be charged 50% of the total cost plus a pro-rate portion of the total cost of the course. A student who withdraws or is dismissed by the School after completing 75% of the course will be charged the total cost of the course.

3.4 VETERAN REFUND POLICY: In the event a student receiving educational benefits from the Veterans Administration withdraws or is dismissed from the School, MST will retain a $10.00 registration fee plus the exact pro-rate portion of such tuition, fees and other charges that the length of the completed course bears to its total length. The exact proration will be determined on the ration of the number of days of instruction completed by the student of the total number of instructional days in the course.

Withdrawal Disclosure

4.1 A student who does not attend classes for a period of five consecutive class days and who does not give the School, prior to or during the period of absence, and explanation regarding the absences is considered to have withdrawn from School. A student who does not notify the School at least one week prior to the class starting that he or she can not attend, will forfeit their deposit.

Placement Service

5.1 This School has no placement service. (By Montana State Law)

NOTICE: This is a legally binding contract upon acceptance by the Montana School of Taxidermy unless cancelled by student within three (3) business days after receipt of acceptance. See attached customer right to cancel form. This is an enrollment agreement instrument and is non-negotiable. Every holder takes it subject to all other claims and defenses of the maker or obligor.
